Belgium has no national trademark office and no national trademark. Coverage for Belgium comes only through a Benelux trademark at BOIP, covering Belgium, the Netherlands and Luxembourg together, or an EU trademark at the EUIPO, covering every Member State (BCIP Art. 1.16, 2.2; EUIPO, Where to register, accessed 2026-09-25).

How Filing Works: From Search to Renewal
- Decide the territory. Benelux if your market is Belgium, the Netherlands and Luxembourg; EU if you trade more widely. We make the call with you, the same day.
- Search the register and the market. BOIP, TMview, the KBO/BCE and open web use, against the goods and services you intend to sell. 1 to 3 working days.
- Assess distinctiveness. Check the sign against the absolute grounds, and reshape the sign or the goods list if it would fail. Runs alongside the search.
- Build and freeze the Nice-classification list. Every class you choose sets your five-year use obligation; the list cannot be widened after filing. 1 to 2 working days.
- File and pay the official fee. Accelerated registration at BOIP costs EUR 196 extra for one class and registers the mark without delay, but absolute-grounds refusal and opposition still apply, and BOIP may cancel it afterward.
- Opposition window opens. Two months from publication at BOIP, three months at the EUIPO; any earlier-right holder may come forward.
- Absolute-grounds examination, then registration. The office tells you in writing if it intends to refuse, with a period to reply, before confirming the registration.
- Use it, then renew. Start genuine use within five years. The renewal reminder comes six months before the ten-year expiry; pay in that window, or use the six-month grace period with a supplement if you miss it.

No. Neither BOIP nor the EUIPO checks for earlier conflicting marks before registering, only afterward, through opposition. A clean availability search lowers risk; it does not clear it.

No. A KBO/BCE entry is a registration fact, not a trademark right: the right exists once the mark is registered. A buy shelf company belgium carries the same unprotected name as a new one.

Can I register a trademark in Belgium only?
No. There is no Belgian national trademark. The right covering Belgium is either a Benelux trademark at BOIP, covering Belgium, the Netherlands and Luxembourg together, or an EU trademark at the EUIPO, covering every Member State (BCIP Art. 1.16, 2.2; EUIPO, Where to register). Both routes protect Belgium; neither is a purely Belgian right.
My company name is already in the Belgian enterprise register (KBO/BCE). Is that not enough protection?
No. The exclusive right in a mark is acquired only by registering it with BOIP or the EUIPO; an unregistered sign cannot be defended in court as a trademark (BCIP Art. 2.2, 2.19(1)). The KBO/BCE entry is a company-law fact, not an intellectual-property right, however long you have traded under the name.
Does a clean search in the BOIP or EU register mean my brand name is free to use?
No. Neither office examines relative grounds before registering a mark; an earlier-right holder must come forward within the opposition window, two months at BOIP or three at the EUIPO, or the mark proceeds (BCIP Art. 2.11(1), 2.14(1)). A clean search lowers the risk. It does not clear it, and unregistered well-known marks can still challenge you later.
Benelux or EU: which one should I file?
Benelux if your market is Belgium, the Netherlands and Luxembourg. EU if you trade more widely: the EU right is all or nothing across every Member State, so one problem in one country can sink the whole application (EUTMR Art. 1(2)). The fallback is conversion into national applications, including Benelux, keeping the original filing date (EUTMR Art. 139).
Should I pay extra for accelerated registration at BOIP?
It buys speed, not certainty. The mark is registered without delay, but absolute-grounds refusal and opposition still apply afterward, and BOIP may cancel the registration (BCIP Art. 2.8(2)). It also moves the start date of your five-year use clock to the date the mark can no longer be refused or opposed (Art. 2.23bis(2)).
Do I have to actually use the trademark once it is registered?
Yes. Within five years of completion of the registration procedure, on the classes you filed, or the mark becomes vulnerable to revocation and to a non-use defence raised against you (BCIP Art. 2.23bis, 2.23ter). Keep dated evidence of use for every class: it is what answers a non-use challenge later.
What happens if somebody opposes my application?
The office hears both sides, may suspend the case, and the losing party pays the costs (BCIP Art. 2.16(5)). The opposition fee alone is EUR 1,045 at BOIP or EUR 320 at the EUIPO, so a founder who has done no clearance work risks paying for a fight a search could have flagged.
I am not established in the EU or the Benelux. Can I file the application myself?
At the EUIPO, yes for the filing itself; representation by an EEA-qualified legal practitioner is then required for everything that follows (EUTMR Art. 119(2), 120(1)). The equivalent Benelux rule is not settled from a primary source we could retrieve, so this page does not assert a position on it either way.
Can I add more products or services to my trademark after I have filed it?
No. The list of goods and services is frozen once the application is submitted; neither office lets you widen it afterward. Choose your classes for what the business will actually sell within the next five years, since the use clock runs against every class you filed.
What happens if BOIP or the EUIPO refuses my application?
No registration follows, and the fee already paid is not refunded. The refusal is not final while it can still be appealed (BCIP Art. 2.11(5)), so a refusal on absolute grounds is not always the end of the file.
When do I renew a Benelux or EU trademark, and what happens if I miss the deadline?
Ten years from the filing date. Pay in the six months before expiry. A further six-month grace period follows, with a supplement, EUR 135 at BOIP or 25% of the belated fee, capped at EUR 1,500, at the EUIPO (BCIP Art. 2.9(4); EUTMR Art. 53(3)). A reminder that never arrives changes none of this.
I already hold a Benelux trademark. Can I extend the same right to cover the whole EU?
You can claim the seniority of the Benelux registration in an EU application for the same mark and the same goods, within two months of the EU filing date, with supporting documents within three months (EUTMR Art. 39(1), (2)). It does not replace filing; it preserves your earlier date inside the new right.
Can I register for the Netherlands now and add Belgium to the same right later?
No. The Benelux trademark is one right for the whole of Belgium, the Netherlands and Luxembourg together; an assignment or transfer not made for the whole territory is null and void (BCIP Art. 2.31(2)). There is no route to add one Benelux country to a right filed for less than all three.
Is there financial support for a small company registering a trademark?
The EUIPO's SME Fund can reimburse part of the official fee for an SME established in the EU, with savings stated as up to 75% on IP right applications. The 2026 call's exact voucher amount and dates were not confirmed at the time of writing, so no figure beyond the 75% ceiling is published here.
How much does an EU trademark cost compared to a Benelux trademark?
EUR 850 electronically for one class at the EUIPO, for ten years, against EUR 244 for one class at BOIP, also for ten years. See the fee table above for the second-class, renewal and opposition figures on both sides; the EU right also covers far more territory for the higher fee.
